行政院修兒少法 虐童最高罰鍰60萬元 | Taiwan revises law on child protection, introduces harsh penalties

為防止虐童及狼師事件再度發生,行政院今(14)日通過衛福部擬具的「兒童及少年福利與權益保障法」部分條文修正草案。

TAIPEI (The China Post) – Taiwan Cabinet passed the draft amendments of “The Protection of Children and Youths Welfare and Rights Act” proposed by the Ministry of Health and Welfare (MHW) aimed at curbing child abuse.

針對包括供應酒、檳榔給兒少、對兒少為特定禁止行為等都將重罰,由現行5倍提高到10倍,最重可處60萬元罰鍰。

The new bill imposes heavy penalties, up to NT$600,000 (US$19,886), on those who abuse children or provide them with alcohol and betel nuts – 10 times higher than the current regulations.

行政院長蘇貞昌表示,這次修法是盤整兒少人身安全防治之漏洞及執行不足之處,從法規面強化並規範司法及早介入兒少保護案件調查程序,以期有效預防遏阻兒虐事件發生。

The revision further fixes loopholes and addresses previous deficiencies regarding youth safety, said Premier Su Tseng-chang who expressed hopes to curb child abuse by improving judicial oversight.

這次修法將高風險處遇、緊急保護安置等條文,都明定司法介入兒少保護調查程序機制,在遇有危急狀態時,明定不用等到有犯罪嫌疑,就可以由警察機關報請檢察機關處理,加強兒保案件處遇效率。

The amendments also aim to better address urgent situations with a new procedure that allows police to report cases directly to the Prosecutors Office.

另外,對於托嬰中心不當對待孩子,衛福部表示,這次修法也授權中央主管機關,訂定托嬰中心裝設監視器的管理規範,讓家長能安心送托。

In addition, the Ministry of Health and Welfare (MHW) said that the amendments require government agencies to draft new regulations for the installation of CCTV systems at childcare centers to reassure parents.
